Tennessee Laws Governing Elder Law 

Tennessee has strict legal requirements relating to elder law. Therefore, it's important to understand these key laws so you can make better-informed choices for yourself or your family members. Some key aspects to be aware of include the following.

• Medicaid eligibility: In Tennessee, you must meet specific income and resource criteria to be eligible for Medicaid. The state’s Medicaid program (known as TennCare) has strict guidelines, including a five-year “look-back” period for asset transfers, where assets given away or sold below fair market value may affect eligibility. Medicaid planning is essential to avoiding disqualifications.
  

• Durable power of attorney laws: Tennessee law allows you to assign a durable power of attorney, granting someone the legal right to make financial or healthcare decisions on your behalf. This document eliminates the need for lengthy court proceedings in the event that someone becomes incapacitated.
  

• Elder abuse protections: Tennessee has strong protections against elder abuse under state laws. Mandated reporters, such as health professionals and caregivers, must report suspected cases of elder abuse. Criminal penalties apply to perpetrators of physical, emotional, or financial abuse.
  

• Spousal protections for Medicaid: Tennessee recognizes protections for spouses of those receiving Medicaid benefits. These provisions, known as the Spousal Impoverishment Rules, protect the spouse at home from impoverishment due to the cost of care for the institutionalized spouse in a long-term care facility.
